CCP RFP Application Period 18B Updates

June 4, 2018
74 applications passed the background check portion of the Commercial Cannabis Permit Program. The remaining applications were then evaluated by the City's third party consultants who utilized the criteria articulated in the Council approved RFP and its instructions to score each. The process was very competitive with only 22 applications advancing to the final round interviews. For this first round of applications, the City took a metered approach to the total number of applicants staff would interview and potentially recommend to the City Council. Only those applications who were scored above the score thresholds set by the City Manager were selected for a final round interview with City staff. 
Staff will be interviewing each of the final 22 over the next month and will be bringing forth final recommendations to Council towards the end of June for all types except for retail. Recommended retail operators will come to Council in July due to interview scheduling timing constraints. 
Unfortunately, the City cannot re-consider any applications at this time. Applicants will receive a score report narrative that will explain their application score with the return of the remainder of the application’s refundable deposit in the coming weeks. The City encourages applicants to re-apply with the City in future rounds. Their contact information has been added to an interested parties list so information on future rounds can be sent to them as the rounds open.

Please note the following: The City will not be issuing any temporary permits. The City anticipates the next round of applications taking place later this year. Additionally, due to the total number of applicants and limited staff time, staff will not be holding office hours with any applicants during this process. 

February 26, 2018

A public hearing regarding the taxation of cannabis businesses in Hayward is scheduled for the March 6, 2018 City Council Meeting. Interested parties are invited and encouraged to provide public comment. Materials on the proposed tax rates will be posted at 72 hours prior to the meeting date. Meetings begin at 7:00PM and take place in the Council Chambers at Hayward City Hall (777 B Street, Hayward, CA 94541).

Due to the overwhelming number of applications, the City had to rebid its application evaluation services contract. Staff anticipates having a new contract executed by the end of March, with the review of applications commencing in April.

December 22, 2017 - January 2, 2018- City Hall Closure

City Hall will be closed during this time. No applications will be accepted during this period. 

January 12, 2018- Submission Deadline 

Applications must be received by the City by 12:00 PM PST on this date. No late applications will be accepted. 

Two physical (hard-copy) applications, as well as one electronic copy (in a single PDF file stored on a USB drive), shall be submitted by mail, courier, or in person to the following address:

Application Fees 

Each application must be accompanied by a $5,000 deposit to cover the cost of processing and reviewing of the application. In accordance with the City’s current Master Fee Schedule, if costs for processing the application(s) exceed the $5,000 deposit amount, the Applicant will be billed for any additional expenses on a time and materials basis. Application fee is due at time of application submittal. Payment shall be made via check, money order, or cashiers’ check payable to the “City of Hayward”. Cash and credit card payments will not be accepted. Applicants will also be responsible for paying for their livescan background check.

General Conditions of Submittal 

  1. Applicants must adhere to the specified page limits for each section. Additional content that exceeds these limits will not be considered. Applications should be prepared in Times New Roman, 12-point font and should be single-spaced, with 1-inch margins. All tables, figures, graphics, etc. are included in the page limits, except where specifically noted otherwise.  

  1. By submitting a proposal, the Applicant represents and warrants that: 

(a) The information provided is genuine and not a sham, collusive, or made in the interest or on behalf of any party not therein named, and that the Applicant has not directly or indirectly induced or solicited any other Applicant to put in a sham proposal, or any other Applicant to refrain from presenting information and that the prospective provider has not in any manner sought by collusion to secure an advantage.  

(b) The Applicant has not paid or agreed to pay any fee or commission, or any other thing of value contingent upon the award of an exclusive operating area, to any employee, official, or existing contracting consultant of the City of Hayward.  

  1. All costs of preparation of proposals including travel for any interviews scheduled shall be borne by the applicants.  

  1. All proposals become the property of the City of Hayward. The City reserves the right to reject any and all submittals; to request clarification of information submitted; to request additional information from competitors; and to waive any irregularity in the submission and review process. None of the materials submitted will be returned to the bidder.  

  1. Information or materials submitted in response to this application will be stored on file with the City of Hayward, and may subject to the requirements of the California Public Records Act, or subject to public disclosure as ordered by a court of law.  Proposed security plans shall be considered confidential.   

  1. The City reserves the right to request additional information not included in this application from any or all applicants. 

  1. The City reserves the right to contact references not provided in the submittals. 

  1. The City reserves the right to incorporate its standard agreement language into any contract resulting from this application.

Live Scan Background Check

Applicants are strongly encouraged to complete their Live Scan background check with the Hayward Police Department, located at 300 W. Winton Ave, Hayward, CA 94544.
