  On behalf of the City of Hayward and its partners, we welcome you to the SR238 website. On this site you will find timelines, forms, documents, and FAQ’s that will allow you to make informed and timely decisions as the SR238 settlement process gradually comes to a close. Our goal is to expedite the SR238 settlement process in a manner that is fair to the tenants of the Mission Boulevard corridor. We want to assist the long standing tenants of the corridor to preserve their investment in the community. We also want to create new homeowners and a new generation of Hayward residents. Please bear with us as there are many decisions that need to be made, but know that the settlement process will always revolve around the tenants of the SR238 corridor. Bullet Available Tools for Homebuyers
  Please be aware that the City of Hayward’s First Time Homebuyer Program (FTHB) uses two powerful tools to assist future homeowners. HUD 203k Program loans allow the buyer to roll the costs of repairs to rehabilitate a house into the mortgage loan if the property cannot be financed due to damage. The FTHB Program loan may also be used with a Veterans Administration (VA) first-mortgage loan which may offer 100% financing with no mortgage insurance requirement for qualifying military veterans.   • Late July, 2010 – on site tenant meetings begin for income qualification/tenancy;
  • Late September 2010 – City contracts for appraiser and property inspector;
  • Late October 2010 - Tenant interview and documentation process complete;
  • November 2010 – First Time Home Buyer Seminar for SR238 Tenants;
  • November 2010 – Public meetings for Bunker Hill area;
  • January 2011 – Deadline to choose Lump Sum Settlement or Opportunity to Purchase a Home;
  • February 2011 – Approximate date for Cal Trans property single family property sales begin (in conjunction with the federal court - start of property sales is contingent upon dismissal of La Raza Unida of Southern Alameda County, et al v. Samuel K. Skinner etc. et al. court case);
  • April 2011 – Decisions on Bunker Hill area property dispositions;
  • May 2012 – Escrows or home purchase must be completed;
  • June 2012 - End of settlement process.
Bullet Frequently Asked Question:
  How do I Utilize Home Inspection Services?
 
  • The City of Hayward has contracted with two independent firms for home inspection services. These services will be available after February 1, 2011;
  • In January the City will send a notification to eligible SR238 tenants announcing that home inspection services are available;
  • Tenants who wish to schedule inspectors will contact the City of Hayward: Stacey Sorensen at 510-583-4233 or Joanne D’Agostino at 510-583-4245;
  • Tenants must be in the Opportunity to Purchase a Home Program (OPHP) in order to request inspections;
  • Inspections will be made available only for eligible single family residences in the SR238 corridor;
  • The City will order inspections for only two properties (a primary address and secondary address if needed) per eligible corridor household per Agreement Section “h” on page 14;
  • Inspections requested for homes not occupied by the primary tenant will be arranged in conjunction with CalTrans which may increase response times;
  • Once assigned by the City, the inspector will contact the address tenant directly within 48 hours to make an appointment;
  • Inspections will occur during normal business hours;
  • Inspections will occur within 14 business days of contacting the City;
  • Home inspections will occur after appraisals. Home inspections will not inform the appraisal process;
  • Original reports will be the property of the City, with copies and electronic scans made available to CalTrans and SR238 tenants. Reports will be available approximately 7-10 days after inspection; and
  • Inspections are not subject to the Agreement appeal process.
  Must I participate in the Opportunity to Purchase a Home Program (OPHP) to get a first right to purchase my eligible CalTrans property?
  If you are a tenant in good standing who wishes to retain a first- right to eventually purchase your current eligible CalTrans rental home, you must choose the Opportunity to Purchase a Home (OPHP) option when electing the disposition of your Lump Sum Settlement (LSS). OPHP gives eligible tenants access to the first right to purchase, appraisal and inspection services, and first time homebuyer funds (if needed) for eligible SR238 properties.
  Do I have to move from my CalTrans Home?
  Neither the City of Hayward nor CalTrans is requesting or requiring that SR238 corridor tenants move. During the early part of 2011, CalTrans will begin the process of selling the first residential properties along the Corridor to the tenants in the Corridor who have expressed an interest in purchasing their home. It is estimated that residential property sales will occur throughout 2011. During 2011, Caltrans will also begin the public auction of some properties, both residential and commercial.

CalTrans will alert tenants in writing to property sales a minimum of 60 days prior to any sale. Eventually, many SR238 CalTrans tenants will likely need to negotiate with new private landlords regarding rental/tenant issues, particularly in multi-family complexes. It is the goal of the City of Hayward and CalTrans to eventually convert all State-owned properties along the SR238 Corridor back to private ownership.
  How do I Utilize Residential Inspection and Appraisal Services?
 
  • The City of Hayward has contracted with Hulberg and Associates and Real Property Valuation Services for residential appraisal services and Property Inspection Team and Tarkington Home Inspections for home inspection services. These services will be available after December 1, 2010;
  • In November the City will send a postcard to eligible SR238 tenants announcing that appraisal and home inspection services are available;
  • Tenants who wish to schedule appraisers/inspectors will contact the City of Hayward: Stacey Sorensen at 510-583-4233 or Joanne D’Agostino at 510-583-4245. Please do not contact the above companies directly;
  • Appraisals/inspections will be made available only for eligible single family residences in the SR238 corridor;
  • The City will appraise/inspect only two properties (a primary address and secondary address if needed) per eligible corridor household per Agreement Section “h” on page 14;

  • Home inspections will occur after appraisals. Home inspections will not inform the appraisal process;
  • Original reports will be the property of the City, with copies and electronic scans made available to CalTrans and SR238 tenants. Reports will be available approximately 7-10 days after inspection; and
  • Appraisals and inspections are not subject to the Agreement appeal process.
  So I’ve received my SR238 Lump Sum Settlement award letter. What’s next?
  If you have received your SR238 award letter, please return the Payment Election Form (found below in the “Documents” section of this webpage) ASAP. Within 30 days of receiving your original signed Payment Election Form, you will receive a letter from the City letting you know that your check is ready for claim, or that your settlement has been placed on deposit with the City for a home purchase if applicable. All checks must be claimed in person at Hayward City Hall (777 “B” Street – 2nd Floor) during normal business hours. In order for the City to issue a settlement check, or for funds to be placed on deposit for home buying, all SR238 tenants must sign an Acknowledgement and Release form (Exhibit “D” of the SR238 Settlement Agreement). This form will be supplied when you claim a settlement check. Tenants who have their funds placed on deposit with the City for home buying purposes must also sign the Acknowledgement and Release form and should do so ASAP at Hayward City Hall (no funds will be released into escrows without the completed release form). All awards are subject to reporting to the Internal Revenue Service, and no withholding will be offered.
  What are my options for using a Lump Sum Settlement Payment?
 
  1. You want to buy your CalTrans home. You MUST put your LSS on deposit with the City as a good faith deposit and funds will be utilized as part of down payment, rehabilitation to qualify for financing, and/or to compliment First time Homebuyer funds. This deposit is held pending the need for downpayment assistance, or sale of the house (or both). LSS deposits will be returned with interest earned at the City’s investment rate (at least 2%), if buyers do not qualify for financing, or the home is found to have significant structural defects and cannot be financed. If you do not qualify for downpayment assistance (e.g., over income) you still must place LSS funds on deposit, which will be paid out into escrow before the close of escrow on the CalTrans house.
  2. You don’t want to buy your CalTrans Home, but want to buy a home in Hayward. You CAN, and are encouraged to place your LSS on deposit and get priority downpayment assistance (contingent on funding). You can elect NOT to place your funds on deposit, and use your LSS on the open real estate market without additional assistance if you elect not to apply, or do not qualify for, additional housing assistance. You may also “buy back in” within six months by depositing your LSS payment amount plus 2% simple interest. All downpayment funds are reserved at a first-come, first-served, basis based on funding availability.
  3. You want to buy a house in Alameda County. You do NOT place your funds on deposit, but rather use your LSS in conjunction with a realtor and Alameda County housing programs. Assistance levels may not be similar to the City’s housing assistance programs.
  4. You live in Bunker Hill and wish to buy a home. As in Scenario # 1, you MUST place your LSS on deposit with the City as a good faith deposit and funds will be utilized as part of down payment, rehabilitation to qualify for financing, and/or to compliment First time Homebuyer funds. However, if it is found that houses are unsalable due to structural and offsite issues, monies will be refunded with interest earned at the City’s investment rate in 2011. Bunker Hill residents still get the opportunity to purchase another eligible SR238 corridor home if the primary tenant does not wish to purchase the home themselves.
  5. Your don’t want to buy a house at all. You do NOT place your LSS on deposit with the City, but rather elect to take a cash settlement, sign the mandatory release, and receive a settlement check within 30 days.
